Fived.ee terms of sale and use

1. Seller and scope
Fived.ee is operated by FIVED TRADE OÜ, registry code 17513407, Harju County, Tallinn, Kesklinn district, Maakri 19/1, 10145, Estonia. Email: info@fived.ee, telephone: +372 5364 1093.
These terms apply to use of fived.ee and sales contracts concluded in the store. The store primarily serves customers in Estonia and delivers in Estonia using the methods offered at checkout. Mandatory statutory consumer rights are not limited by these terms.
2. Products and information
Descriptions, specifications, images, prices and availability are shown in the store. Before ordering, the buyer must check the model, dimensions, connections, compatibility and contents. Accessories shown in a product image are not included unless stated otherwise. We aim for accuracy, but manufacturers may change packaging or minor features. If a material error in the description, price or stock is found, we contact the buyer before fulfilment.
3. Prices
Prices are in euros. Prices shown to consumers include applicable taxes unless clearly stated otherwise. Delivery is added according to the method selected at checkout. The final amount is shown before confirmation. FiveD Trade OÜ may change prices and campaigns; changes do not affect an existing contract except for an obvious price or technical error, in which case we will offer confirmation at the correct price or cancellation with a refund.
4. Placing an order
- Select products and add them to the cart.
- Check quantities, prices, specifications and cart contents.
- Enter correct contact, billing and delivery details.
- Select a delivery and payment method offered at checkout.
- Review the terms, confirm and pay.
The buyer is responsible for the accuracy of submitted data. Incorrect data may cause delays or additional costs.
5. Contract and confirmation
An order is an offer to conclude a sales contract. The contract is concluded when FiveD Trade OÜ accepts the order and sends confirmation or starts fulfilment. An automatic payment notice does not necessarily confirm final availability.
We may refuse fulfilment for an objective reason, including out-of-stock goods, failed payment, incomplete data, impossible delivery, an obvious price or product-information error, or a justified suspicion of fraud. In that case we notify the buyer and refund the payment in full.
6. Payment
Montonio is used as payment intermediary. Checkout may support Estonian bank links and debit or credit cards. Payments are processed by Montonio, banks and card providers. FiveD Trade OÜ does not store full card details. Orders are processed after payment confirmation; if payment fails, the seller is not obliged to reserve the goods.
7. Delivery in Estonia
Delivery is made to Omniva, DPD and Smartpost parcel lockers and by courier. Smaller parcels are sent to a locker where possible; larger or heavier shipments are sent by courier. The method and final price are shown at checkout. Orders with a product subtotal of at least €499 receive free standard delivery in Estonia. 8. Delivery time and delay
Delivery time depends on availability, processing, destination and the transport partner. Unless a separate deadline is agreed, goods are delivered without undue delay and no later than 30 days after the contract is concluded. If fulfilment is delayed, we notify the buyer. Where provided by law, the buyer may set an additional reasonable deadline and withdraw after it expires.
9. Changes or cancellation before dispatch
To change or cancel an order, write as soon as possible to info@fived.ee. Once handed to the transport partner, a change may not be possible and the withdrawal and return procedure applies.
10. Consumer withdrawal
A consumer may withdraw from a distance contract without giving a reason within 14 days of receiving the goods. Use the Withdrawal from the contract page or send a clear notice to info@fived.ee. Exceptions, return costs, reduction in value and refunds are described in the return and refund policy.
11. Returns and refunds
Goods must be returned no later than 14 days after the withdrawal notice. The consumer bears direct return costs unless the goods were wrong, damaged or defective or we agreed otherwise. We may wait for the goods or proof of return before refunding. The consumer is responsible for reduction in value only where the goods were handled beyond what was necessary to check their nature, properties and functioning.
12. Defects and complaints
If goods do not conform, write to info@fived.ee with the order number, issue description and photographs where possible. The consumer may complain within the statutory period; in consumer sales the seller is generally responsible for a defect appearing within two years of delivery. Remedies may include repair, replacement, price reduction, termination or refund, taking account of the nature and proportionality of the defect.
13. Warranty
A manufacturer or seller warranty applies only when stated for the product or in a warranty document. It does not replace or reduce statutory consumer rights. Unless warranty terms say otherwise, it does not cover normal wear, misuse, accident, unauthorised repair or failure to follow instructions.
14. Buyer obligations
The buyer must use products as intended, follow use and safety instructions and check suitability before installation. Work requiring specialist skills must be performed by a competent professional. The seller is not liable to the extent damage results from incorrect installation, use or maintenance.
15. Liability
The parties are liable for breach under Estonian law. FiveD Trade OÜ's liability is not excluded or limited where prohibited by law, including intentional or grossly negligent conduct and mandatory consumer rights. The seller is not liable for temporary interruption or delay by third-party providers outside its control, but will assist where possible.
16. Force majeure
Failure may be excused by force majeure that a party could not influence, reasonably foresee or avoid. We notify the buyer, take reasonable steps to reduce the impact and perform as soon as possible. Statutory consumer rights remain in force.
17. Business buyers
If the buyer acts in business or professional activity, consumer-specific provisions, including the 14-day withdrawal right, do not apply unless agreed in writing. Terms for larger volumes and regular purchases may be agreed in a personal offer or separate contract.
18. Personal data
Personal data is processed under the privacy policy and applicable law. Necessary data is shared with payment and delivery partners to fulfil orders.
19. Intellectual property and website use
The design, texts, logos, photographs and other content belong to FIVED TRADE OÜ or the respective rights holders. Content may not be copied, distributed or used commercially without permission except where permitted by law.
20. Changes to the terms
FIVED TRADE OÜ may change these terms when services, processes or legislation change. The terms applicable at the time of ordering apply to that order. The current version is published on the website.
21. Applicable law and disputes
Estonian law applies. Send a complaint with the order number and circumstances to info@fived.ee. We seek to resolve disputes by negotiation. If a consumer dispute cannot be resolved, the consumer may contact the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority or a competent court. This does not limit other statutory remedies.
